The go-kart track located in the Wroclavia Shopping Center, ul. Sucha 1, 50-086 Wrocław, Level -2 parking, is operated by MSA INVESTMENTS Spółka z ograniczoną odpowiedzialnością (LLC), headquartered in Chrościna at ul. Nowowiejska 35, 46-073 Chrościna, entered in the Register of Entrepreneurs by the District Court in Opole, 8th Commercial Division of the National Court Register under KRS number: 0000912771, NIP: 9910540867, REGON: 389502438, with share capital of PLN 5,000, hereinafter referred to as the Organizer.

§ 1 DEFINITIONS

Terms used in these Regulations shall have the following meanings:

Organizer – MSA INVESTMENTS Spółka z ograniczoną odpowiedzialnością (LLC), as described above; Participant – a natural person who, in accordance with these Regulations, may use the Organizer’s offer; Facility – the go-kart track located in the Wroclavia Shopping Center, ul. Sucha 1, 50-086 Wrocław, Level -2 parking; Go-kart – a vehicle offered by the Organizer for use on the track; Entry Ticket – a document confirming the conclusion of a contract between the Organizer and the Participant, enabling the Participant to use the Go-karts and the Facility for a specified period and price as set in the price list, under the terms specified in these Regulations; Ride – a go-kart drive provided to the Participant by the Organizer at the time and location designated by the Organizer; Pitlane – the path between the box and the track; Regulations – the regulations of the go-kart track.

§ 2 GENERAL PROVISIONS

The Organizer shall post the Regulations in a visible and accessible location for all potential Participants.

Conditions for using the Facility:

  • Payment for access to the Facility;
  • Completion of training;
  • Familiarization with and acceptance of these Regulations;
  • Signing a relevant statement by the Participant;
  • Providing personal data (name, surname, date of birth, email address) necessary for service execution.

Before entering the Facility, Participants and their guardians must read the Regulations and confirm this by registering in the Pitlane system.

Go-karts LR5 are available for persons aged 7 and up. Participants under 16 may use the track only with written consent from their legal guardians. Maximum allowed driver weight: 120 kg for RSX go-karts, 100 kg for LR5.

Access to the track is not permitted to individuals who:

  • Are under the influence of alcohol, drugs, or any other substances affecting reaction time or psychophysical abilities. The decision lies with the Track Manager.
  • Have medical contraindications, including heart, lung diseases, epilepsy, etc.

Use of the track requires payment and completion of training. Prices are set by the Organizer and listed on-site and at www.gokartywroclaw.pl. VAT invoices must be requested before the receipt is issued.

All Participants must undergo training by Organizer staff. If a Participant does not understand any rules after training, they must immediately consult Organizer staff.

By starting a Ride, the Participant confirms they are sober and not under the influence of substances or medication impairing reaction or driving ability.

The Organizer may deny or terminate a Ride if the Participant violates the Regulations or poses a safety risk. Such individuals will be removed without refund. The Organizer may, with consent, conduct sobriety or substance tests.

§ 3 TRACK AND FACILITY USE RULES

The Organizer sets the number of Go-karts on the track and their start sequence.

The Participant must:

  • Report malfunctions by raising a hand and waiting for staff assistance in a safe area;
  • Keep both hands on the steering wheel during a Ride;
  • Drive only in the designated direction;
  • Maintain at least 5 meters between Go-karts;
  • Stay in the vehicle and not enter the track unassisted;
  • Enter the track on the starter’s signal only;
  • Slow down and exit the track after the Ride;
  • Remain seated until the engine is off and instructed to leave by staff.

The Organizer’s staff will assist in case of vehicle malfunction.

Prohibited:

  • Bumping barriers or other go-karts;
  • Exiting the vehicle or extending limbs during the ride;
  • Driving one-handed;
  • Removing helmets while driving;
  • Unauthorized access to the track;
  • Hindering other drivers;
  • Driving in the wrong direction;
  • Unnecessary stopping;
  • Blocking others.

Alcohol consumption and smoking are strictly prohibited on the premises. If the Participant damages a Go-kart, the Organizer is not obligated to provide a replacement. No refunds will be granted after completing a Ride or for missed Rides due to Participant fault. Spectators must stay in designated areas.

§ 4 ORGANIZER AND PARTICIPANT RIGHTS & OBLIGATIONS

Organizer obligations:

  • Enable a Ride after Participant meets conditions;
  • Maintain go-karts and equipment in good condition.

Organizer rights:

  • Issue instructions and safety guidelines;
  • Deny or interrupt Rides for safety or Regulation breaches;
  • Request ID to confirm Participant age;
  • Conduct sobriety or drug tests with consent.

Participant obligations:

  • Comply with the Regulations and safety rules;
  • Follow Organizer instructions;
  • Prepare for Ride, including:
    • Undergo training;
    • Secure loose items (phones, keys, wallets);
    • Wear balaclava and helmet; tie hair securely;
    • Ensure clothing does not interfere with equipment;
    • Wear flat-soled shoes.

§ 5 LIABILITY

Participants use Go-karts and Facility at their own risk. Participants are liable for damage caused to people or property through their actions. The Organizer is not liable for accidents or damage caused by Participants or third parties. Participants must cover repair costs for damages caused by them. The Organizer is not liable for lost, damaged, or dirty items/clothing.

§ 6 TRACK RESERVATION TERMS

Track and other Organizer services are paid per price list available on-site and at www.gokartywroclaw.pl

Reservation conditions:

  • Participants may book via Pitlane system;
  • Online bookings require account creation at www.gokartywroclaw.pl/rezerwacja
  • Reservation fees are non-refundable if canceled within 5 days of the booking date;
  • Arrival at least 20 minutes before the scheduled Ride is required;
  • Late arrivals will not extend Ride time;
  • Reservation is valid only for the number of people specified;
  • Changes to the number of participants are subject to Organizer approval;
  • No-shows or intoxicated arrivals void the reservation without refund;
  • Unpaid bookings are canceled after 10 minutes;
  • Refunded credits are visible in the client panel under Credits and will be auto-used for future bookings;
  • Failure to cancel on time subjects the booking to prepayment rules;
  • 100% prepayment is required at reservation;
  • Prepayments for uncanceled bookings are non-refundable due to Organizer’s incurred costs.

§ 7 FINAL PROVISIONS

All persons at the Facility must follow the Regulations and staff instructions.

Complaints may be submitted in writing to the Organizer’s address or by email to kontakt@gokartywroclaw.pl. The Organizer will respond within 14 days. Complaints must include:

  • Full name
  • Email address
  • Phone number
  • Reservation date
  • Reason and description of the issue

The Organizer is not liable for improperly submitted complaints, especially those with incorrect data.

The Facility is under video surveillance for the safety of Participants, staff, and property. Recordings are stored for up to 3 months unless needed for legal proceedings.

For matters not covered by these Regulations, the provisions of the Civil Code shall apply.
